All content and changes need to be provided by the client in writing. AZ-Web does not spell check or proofread copy (text) when building web pages. There will be additional charges if AZ-Web has to go back to pages and correct typos or change content. If it is an error made by AZ-Web it will be corrected at no charge.
Dead Projects / Closed Account
A dead project is any project which includes, but is not limited to any the following:
Downtime - What to do if your site is down.
If your site is down due to a failure on the part of AZ-Web or our services, AZ-Web will credit the client for each day the site is down at the clients' current hosting rate, only if the client requests to receive a credit and the request must come within 7 days of the actual outage, and the outage must be on the part of AZ-Web, not on the side of the ISP. If the site is down due to problems with the clients' ISP or internet connection such as their dialup service, DSL, cable modem, T1 or any other type connection, AZ-Web is not responsible in any way and not required to assist the client in getting reconnected.
Images
It is up to the client to obtain a proper license for all images on their site. AZ-Web has a substantial library of images, but in many cases we will use images for placement and it will be up to the client to pay for the license. If a proper license is not obtained for each image, AZ-Web is in no way responsible to pay any penalties. Original image ownership information will only be kept by AZ-Web during the development of the site. Once the site is developed it is the responsibility of the client to manage their proof of license.
Flash Changes
If the client is having Flash® design work done of any kind, AZ-Web will provide the client with up to two design sessions within the first 30 days. The client must complete changes and send revisions back to AZ-Web within 7 days after each session. All revisions must be possible. Possible is defined as Flash techniques within the capabilities of AZ-Web. After the second design session AZ-Web will charge the rate of $120 per hour. Flash design work is any work that has to be done using either Macromedia Flash or Adobe LiveMotion software.
Programming Changes
If the client is having programming work done of any kind, AZ-Web will provide the client with one design session within the first 14 days. For any additional programming AZ-Web will charge the rate of $120 per hour. Programming work is any work that has to be done using any programming tools, databases or languages such as perl, HTML, PHP, C, C++, ASP, Java, Javascript, CGI, SQL, MySQL, or any other programming language not mentioned here.
Who's In Charge
At the time of the contract, AZ-Web and the client will establish one Primary Contact. All communication between AZ-Web and the client will be with the single point of contact for the client. If the client needs to change the point of contact it must be submitted in writing directly from the original point of contact or the President or Owner of the clients' business. No work or changes will be done without written authorization from the appropriate contact(s). This policy is to protect your website and its content from unauthorized access.
Primary Contact
The individual who signs the Web Contract will be designated as the Primary Contact for the account. The Primary Contact will be one individual from the company who will be responsible for providing all information, all materials, and all change requests for the whole duration of working with with AZ-Web. Passwords and private information about the client's account will not be released to any other individual without written request of the Primary Contact. Other individuals, even if an employee of the company, may not send web content to AZ-Web, to prevent any conflict of interest between employees within the client's company.
Timeline
Once AZ-Web has published any work, for public viewing or not, the client has 7 days to submit corrections or changes. Corrections (mistakes made by AZ-Web) will be done at no charge. Changes will be done at no charge for the first two changes (design work only, see specific number of changes for Flash® and Programming above) and billed at $120 per hour for additional changes.
Payment
AZ-Web accepts Visa, Mastercard, Discover, American Express, and also checks, cash, and wire-transfer. Due to the environment of the internet it is impossible to protect any material on the web once it has been published. Therefore, all work must be paid for in advance unless special arrangements are made.
If arrangements have been approved by AZ-Web to split the payment into two halves the first half is do at signing and the second half is due prior to going live. No site will go live to the public until 100% of the work has been paid for. Under no circumstances will the first half of the design fee will be refunded as long as AZ-Web has performed the work requested, even if the client does not approve the work. This is due to the amount of time needed to develop the various aspects of the project.
Monthly payments are due by the 26th of each month. A late fee of $20 will be added for payments received after the 1st of the month.
Shut off day
(for non-payment) is the 5th of each month. In order to reestablish service there is a $100 reconnect fee.
Refunds
Deposits are non-refundable. There are no refunds for hosting of any kind. AZ-Web works with clients on a month-to-month basis. AZ-Web and clients are allowed to cancel service and the relationship at any time. If additional work is requested without a written contract, refunds will only be given within 30 days of published date. AZ-Web, Inc. is not responsible if the client fails to provide AZ-Web with content, changes, images, text, or corrections. AZ-Web is only responsible for design, programming and hosting and not responsible for content of the website, visitors, traffic, hits, sales, or any part of the success of the web site or the company or individual.
Flash Refunds
AZ-Web, Inc. only offers 50% refunds on Flash work and only within the first 30 days. Flash is an extremely intensive program which requires much more time to develop.
Who Owns What
All artwork created by AZ-Web is the sole property of AZ-Web. AZ-Web is not responsible for storing or keeping inventory of CD's and disks belonging to clients. Do not give AZ-Web your only copy of anything. AZ-Web is not responsible for materials belonging to clients. Special arrangements can be made to allow AZ-Web created artwork to be used for other purposes by the clients as long as the client is in good standing with AZ-Web. If the client is past due in payments, or if the relationship has ended AZ-Web, Inc. has no responsibility to provide the client with anything.
Online Forms
Each web design project includes one online form, up to 25 fields, and requires hosting with AZ-Web for the CGI script for the "send" functionality of the form. Additional forms are $50 per additional form up to 25 fields each.
Discontinuing Service
We reserve the right to discontinue service for any reason including lack of client cooperation, or failure to adhere to our company policies and terms.
Hosting Agreement Terms
In the case that there is an agreement in the contract for AZ-Web to host a clients website for a specific amount of time, the client agrees to pay for all remaining time of hosting if the client decides to discontinue working with AZ-Web for any reason. The balance is due before any files will be released to the client.
Internet Connection
The client needs to have their own existing internet connection and email account. AZ-Web is not responsible for your internet connection or for your email service. AZ-Web servers can provide the client with email aliasing and POP account services.
Email
AZ-Web does not provide any email support other than configuration of email forwarding and aliasing. The client will need to have their own connection and email account prior to using any of AZ-Web's email services.
Computer Hardware and Software
AZ-Web does not provide support for third party computer hardware and/or software. If the client uses any software package recommended by AZ-Web the client will need to arrange your own installation, and training.
Occasionally, AZ-Web will offer a "Quick-Start" training program for various products such as Adobe GoLive and Adobe Photoshop. The Quick-Start program cost is $120 per person and lasts between one and two hours. The client will need to have the appropriate software installed and operational prior to your Quick-Start training.
In addition, AZ-Web, Inc. uses Apple Macintosh computers to develop graphics and websites. Currently, the Windows and Apple platform of these two products are similar, but there are some interface and functionality differences. Once again, AZ-Web does not guarantee or support any third party hardware or software product.
Training for AZ-Web, Inc. products
Training is available for proprietary products such AZ-Edit, NewsPro, or other products developed by AZ-Web. Training on AZ-Web products varies depending on the product. If training is not covered in your contract for service with AZ-Web, the default training price is $60 per hour, per person.
